Hope and Disappointment: The Supreme Court Verdict on Same Sex Marriage in India

In a recent ruling, India’s Supreme Court dashed the hopes of LGBTQ+ advocates by rejecting petitions to legalize same-sex marriages. Despite a groundswell of public support for LGBTQ+ rights in the country, the court’s decision disappointed many. Chief Justice Chandrachud emphasized that the court couldn’t make legislative changes, highlighting that the power to decide rested with the parliament.

Chandrachud and other justices pointed out that LGBTQ+ marriages could gain recognition through expanded marriage laws or parliamentary decisions. Earlier this year, the court received 21 petitions on legalizing same-sex marriages, sparking a wide range of opinions.

The Chief Justice suggested that societal acceptance could pave the way for marriage equality, stating, “This court can’t create laws; it reflects the values of society.” He encouraged the LGBTQ+ community to seek acceptance and rights by becoming an integral part of mainstream society. However, this perspective left many activists disheartened.

Dr. Mario D Penha, one of the petitioners, expressed his disappointment but urged everyone not to lose hope. “While today brings disappointment, we must keep our hope alive. Even though hope alone won’t bring change, it’s essential not to lose it, even in seemingly futile situations.”

The rejection of these petitions dealt a blow to the dreams of countless LGBTQ+ individuals in India, affecting the lives of many who simply want the freedom to live openly and authentically. Today’s ruling has cast a shadow of disillusionment over our community, but the fight for equality continues.
